Distance sales contract

Article 1 · Parties

Seller: ASD TASARIM LTD. ŞTİ., Osmangazi Mah. Basın Şehitleri Cad. No:174/1 Odunpazarı/ESKİŞEHİR, e-mail: satis@ahsapix.com.

Buyer: the person who gives their name, e-mail address, phone number and delivery address with the order.

Article 2 · Subject

This contract sets out the rights and obligations of the parties regarding the sale and delivery of the goods the Buyer orders electronically through ahsapix.com, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

Article 3 · Goods, price and payment

The type, quantity, options and VAT-inclusive price of the goods are as shown in the bag summary and on the payment page before payment; that summary is an integral part of this contract. Shipping is free. Payment is made by card through Shopier, and the order becomes binding once the payment is confirmed.

Article 4 · Delivery

The goods are made to order and delivered by carrier to the address the Buyer gave within 10 days, and at most 30 days, of the payment being confirmed. Before shipping, the Seller shares photos and a video of the piece with the Buyer. If delivery is delayed by force majeure, the Buyer is told at once and may cancel the order, in which case the amount paid is refunded within 14 days.

Article 5 · Receipt and damage

The Buyer should check the parcel on receipt; if the outer packaging is damaged, the Buyer should have the carrier record it and notify the Seller with photos the same day. Goods damaged in transit are repaired, or made again and shipped, at the Seller’s cost.

Article 6 · Right of withdrawal

There is no right of withdrawal for goods prepared to the Buyer’s specifications and personal needs (custom designs, and pieces made to order in the size and frame the Buyer chooses) (Distance Contracts Regulation, Article 15(1)(ç)).

For Make-it-yourself kits, provided the packaging is unopened and the kit unused, the Buyer may withdraw within 14 days of delivery without giving a reason. Notice is given by e-mail; the price is refunded by the payment method within 14 days of the kit reaching the Seller.

Article 7 · Defective goods

If the goods are defective, the Buyer may use the optional rights in Article 11 of Law No. 6502. Small differences in tone and texture between blocks in handmade goods are not a defect.

Article 8 · Personal data

The Buyer’s personal data is processed as set out in the privacy notice (KVKK) and only to perform the order.

Article 9 · Disputes and entry into force

In disputes, the Consumer Arbitration Committees are competent within the monetary limits announced by the Ministry of Trade, and the Consumer Courts above them. By reading and accepting this contract and the pre-information form before payment, the Buyer accepts all its terms; the contract enters into force when the payment is confirmed.
